  • Petition to appoint Executor (in the case of a Will) or Administrator for the estate.
  • Inventory and appraisal of estate assets by Executor/Administrator.
  • Payment of estate debt to rightful creditors.
  • Sale of estate assets. Payment of estate taxes, if applicable.
  • Final distribution of assets to heirs.

PROBATE ADMINISTRATION

Under Florida law there are two types of probate administration:

  • Formal probate administration: generally filed when the total estate value exceeds $75,000 or in a small estate where there are other issues that require the court's action or intervention (such as estate debts which exceed the value of estate assets).
  • Summary probate administration: may be filed if the total estate value is $75,000 or less (excluding real property) or the decedent died two or more years prior to filing. Summary probate is the equivalent to a “small claims” case in civil matters.

Additionally, there is also a non-court supervised probate administration proceeding which is called a "Disposition of Personal Property Without Administration."
